Isabella's Story
Pseudonyms are used to protect the client's identity.
In 1982, Isabella moved to Australia from England after separating amicably from her husband, though they never formally divorced.
In 2000, Isabella met Sam, and after four positive months, they moved in together.
Isabella relocated into Sam’s home and contributed $100 weekly towards household expenses, also covering groceries and telephone bills, while Sam paid for utilities like water and electricity. They shared household chores equally.
Sam had three children—Linda, Elenor, and Archie—who visited occasionally, typically on Easter, Christmas, birthdays, and rare occasions when passing through the area.
Sam and Isabella deeply cared for each other but chose not to marry due to difficult experiences in their prior marriages.
Isabella had ceased working in 1994 due to health issues, making her financially dependent on Sam.
In 2019, Sam was diagnosed with cancer. In the days leading to his death, Sam chose to discontinue medication, opting for comfort and less pain. Isabella, unable to visit the hospital, learned of his passing when she called the hospital on a Saturday.
Sam’s funeral arrangements were made by his children; however, Isabella covered the funeral expenses from money Sam had set aside for her.
Isabella continued living in the home she shared with Sam, considering it her permanent residence.
In 2022, two years after Sam’s passing, Isabella underwent surgery on her right leg. Shortly after returning home, Sam’s children visited, informing her of their intention to sell the house.
Initially unable to find suitable alternative housing, Isabella was pressured by Sam’s children to quickly accept an offer of one-fifth of the home's value. Feeling uncertain and unaware of the property’s worth, Isabella declined.
Isabella, whose health continued to decline, wished to remain in the home until her passing.
She had become increasingly dependent on the security provided by Sam's home, especially as her medical expenses rose significantly.
Our Approach
In 2022, feeling confused and vulnerable, Isabella sought legal assistance from Dormer Stanhope.
Isabella was informed she was eligible to make a claim as she was a long-term de-facto partner, and as someone financially and domestically dependent on Sam for over 22 years.
Isabella’s case was settled during mediation, resulting in a significant provision of $660,000 to secure her financial stability and accommodation needs.
